The third choice alternative is actually not "The extent to which the action infringes upon someone else's NATURAL rights" but simply "The extent to which the action infringes upon someone else's rights", i.e. in line with what you suggest. (Perhaps Robin Hanson wrote this too quickly on his blog.)
